Welcome to Gymconnect! These Terms of Use ("Terms") govern your use of our SaaS platform ("Service") for gym management, provided by Gymconnect ("we," "us," "our"). By accessing or using our Service, you agree to comply with and be bound by these Terms.

Eligibility

You must be at least 18 years old to use our Service. By using our Service, you represent and warrant that you meet this age requirement.

Account Registration

To access our Service, you must create an account. You agree to provide accurate and complete information during registration and to keep this information up-to-date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Use of the Service

• Gym Owners: As a gym owner, you may use our Service to manage gym operations, including attendance tracking, membership management, and payment processing. You agree to use the Service in compliance with all applicable laws and regulations.
• App Users: As an app user, you may use our Service to interact with your gym, including checking in for attendance, managing your membership, and making payments. You agree to provide accurate information and to use the Service responsibly.

Payments

All payments made through our Service are processed directly between the customer and the gym. Gymconnect does not handle or store payment information. We are not responsible for any issues arising from payment transactions.

Prohibited Activities

You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Interfere with or disrupt the Service or its servers or networks.
• Use automated systems to access the Service in a manner that sends more request messages to our servers than a human can reasonably produce.
• Legal Requirements: When required by law or to protect our rights, safety, and property, or that of our users and others.
• Attempt to gain unauthorized access to any part of the Service or to other user's accounts.

Intellectual Property

All content and materials provided through the Service, including but not limited to text, graphics, logos, and software, are the property of Gymconnect or its licensors and are protected by intellectual property laws. You agree not to copy, modify, distribute, or create derivative works based on our content without our prior written consent.

Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or secure. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Gymconnect shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Service; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service by any third party; or (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Delhi, India.
